Terms and Conditions.

1. The Ticket

1. Each ticket admits one person to the Harvest Festival on October 24, 2026, at Maranatha Farms in Forest, Virginia. Gates open at 12:00 PM.
2. Ticket category - Lawn General Admission, Reserved Seating, Pit, or VIP - determines the seating or standing area to which the holder is admitted. It does not determine admission time or entitle the holder to any other benefit unless expressly stated at the point of sale.
3. A ticket constitutes a limited, revocable license to enter and remain on the event premises for the duration of the event, subject to these Terms. It conveys no property interest and no ownership right in the event, the program, or the premises.
4. The holder is solely responsible for the safekeeping of the ticket. The Foundation assumes no responsibility for tickets that are lost, stolen, damaged, duplicated, or otherwise rendered unusable. Where a ticket barcode is presented more than once, admission will be granted only to the first presentation scanned.
5. Tickets must be purchased from the Foundation or through its authorized ticketing platform, Zeffy. The Foundation does not warrant the validity of tickets obtained from resellers, secondary marketplaces, or any other third party, and cannot assist purchasers who obtain invalid tickets through such channels.
6. Tickets may not be resold above face value, nor used in connection with any commercial promotion, sweepstakes, contest, or giveaway, without the prior written consent of the Foundation.

2. All Sales Final

1. All ticket sales are final. No refunds or exchanges will be issued. This applies without exception to changes in personal circumstance, including illness, travel difficulty, scheduling conflict, adverse weather, or the purchase of an incorrect ticket category.
2. Proceeds from the Harvest Festival support the ministry of Reap the Harvest Foundation, Inc. and its 501(c)(3) partner ministries. Because the purchaser receives admission in exchange for payment, a ticket purchase does not constitute a tax-deductible charitable contribution. Purchasers should consult their own tax advisor regarding their individual circumstances.
3. Tickets may be transferred to another individual at or below face value. Any person attending on a transferred ticket is bound by these Terms. Purchasers transferring Reserved Seating, Pit, or VIP tickets should notify the Foundation in advance so that the registration may be updated.
4. In the event of a demonstrable pricing or transaction-processing error, the Foundation reserves the right to cancel the affected order and refund amounts paid. This constitutes the Foundation's sole refund obligation.

3. Rain or Shine; Program Changes

1. The Harvest Festival is a rain-or-shine event. It will proceed in most weather conditions, including rain, wind, mud, heat, and cold. Attendees should prepare accordingly.
2. The Foundation reserves the right to delay, suspend, shorten, relocate, or otherwise modify any aspect of the event - including the program, lineup, performers, speakers, schedule, activities, and stage configuration - for reasons of safety or for any other reason it deems appropriate. No such modification entitles any purchaser to a refund.
3. The announced lineup is subject to change and is not a term of this agreement. The substitution, withdrawal, or cancellation of any performer or speaker does not invalidate a ticket and gives rise to no refund obligation.
4. Should severe weather, emergency, or other circumstance require the premises to be evacuated or the event to be concluded early, no refund will be owed, notwithstanding that an attendee may have experienced only a portion of the program.
5. In the event that the Foundation cancels the event in its entirety prior to the opening of gates and does not reschedule it, ticket holders will be notified by electronic mail and by notice posted at harvestlyh.com, together with a statement of the accommodation the Foundation is able to extend to purchasers.

4. Assumption of Risk

Attendees are advised to read this Section carefully, as it affects their legal rights.

1. You acknowledge and understand that attendance at the Harvest Festival involves inherent risks of bodily injury, illness, property damage, and, in rare circumstances, death, to yourself and to any person attending on your tickets. Certain of these risks are intrinsic to the activities offered and cannot be eliminated regardless of the care exercised by the Foundation. You knowingly, voluntarily, and expressly assume all such risks, whether known or unknown.
2. Such risks include, without limitation, the following.

Agricultural and outdoor conditions

• Uneven, sloped, muddy, rocky, or otherwise unstable ground, including holes, ruts, ditches, obscured hazards, and areas of tall vegetation;
• Farm structures, fencing, gates, equipment, machinery, implements, and vehicles present on the premises;
• Livestock and petting-zoo animals, the behavior of which is inherently unpredictable and which may bite, kick, scratch, butt, trample, or startle; and the transmission of illness through contact with animals, animal enclosures, or animal waste;
• Hayrides, wagons, tractors, and other moving equipment;
• Weather conditions of every description, including rain, lightning, high wind, and extremes of temperature, together with the mud, standing water, and ground instability arising from them;
• Plants, pollen, dust, hay, insects, ticks, stinging insects, wildlife, and manure, exposure to any of which may provoke an allergic reaction;
• Limited illumination after dark and limited cellular service on the premises.

Rides, attractions, and activities

• Inflatable structures, mechanical rides, climbing apparatus, slides, corn and hay mazes, games, kids-zone equipment, and any physical or recreational activity offered at the event;
• Crowd conditions, including queues, standing-room and pit areas, crowd movement and surges, jostling, tripping, and contact with other persons or objects;
• Amplified sound at high volume and stage lighting effects, which may affect hearing and may affect individuals sensitive to flashing or strobing light;
• Separation from one's party or from minors in one's care.

Food, beverage, alcohol, and third-party vendors

• Food and beverages sold or served at the event may contain, or be subject to cross-contamination with, allergens, including tree nuts, peanuts, dairy, gluten, eggs, soy, and shellfish. The Foundation makes no representation or warranty that any item is free of any allergen. Attendees with food allergies must make their own inquiries of the vendor and exercise their own judgment.
• Food-borne illness.
• Vendors, food service operators, exhibitors, performers, ride operators, and other service providers present at the event are independent contractors and independent businesses. They are not employees or agents of the Foundation. The Foundation does not direct or control their goods, services, equipment, personnel, or safety practices and accepts no responsibility for them. Any dispute concerning goods or services purchased from a vendor lies between the attendee and that vendor.
• Where alcohol is served, it will be served solely by appropriately licensed vendors, only to persons aged 21 or older presenting valid identification. Intoxication constitutes no defense to any provision of these Terms, and the Foundation reserves the right to refuse service to, or remove, any person who appears impaired.

General health and safety

• Each attendee is responsible for assessing his or her own physical condition and limitations, and those of any minor in his or her care, and for declining to participate in any activity that is not appropriate.
• Attendees assume the risk of exposure to communicable illness inherent in any public gathering.
• Any first aid provided on site is basic in nature and is not a substitute for professional medical treatment. In the event of an emergency, you authorize the Foundation to summon and arrange emergency medical care for you or for any minor in your care, at your sole expense.

5. Release of Liability, Waiver of Claims, and Indemnification

1. In consideration of being permitted to purchase a ticket and to attend the Harvest Festival, and to the fullest extent permitted by the laws of the Commonwealth of Virginia, you hereby release, waive, discharge, and covenant not to sue Reap the Harvest Foundation, Inc.; Maranatha Farms and the owners and lessors of the premises; and each of their respective officers, directors, trustees, employees, volunteers, contractors, sponsors, partner ministries, performers, speakers, and insurers (collectively, the "Released Parties").
2. This release extends to all claims, demands, actions, causes of action, damages, losses, costs, and expenses of any nature, including attorneys' fees, arising out of or in any way related to your attendance at the Harvest Festival, your presence upon the premises, your participation in any activity offered at the event, or any loss of, theft of, or damage to your personal property. It applies to claims founded upon the ordinary negligence of the Released Parties, whether the resulting injury or loss is known or unknown, foreseen or unforeseen, and whether presently existing or arising in the future.
3. This release does not extend to gross negligence, willful or wanton misconduct, or intentional wrongdoing on the part of any Released Party, and it does not waive any right that may not lawfully be waived under Virginia law.
4. You further agree to indemnify, defend, and hold harmless the Released Parties against any claim asserted by you, by any minor in your care, or by any person attending on tickets you purchased, and against any claim arising out of your own conduct at the event, including damage caused by you to the premises or to the property of others.
5. Should any provision of this Section be held unenforceable, the remaining provisions shall continue in full force and effect. The aggregate liability of the Released Parties to any purchaser in connection with the event shall in no event exceed the amount paid by that purchaser for the ticket or tickets concerned.
6. Purchases on behalf of minors. If you purchase tickets for any person under the age of eighteen, you represent that you are the parent or legal guardian of that person, or that you act with the express permission of the parent or legal guardian. You accept these Terms on that person's behalf, you undertake to supervise that person at all times while on the premises, and you grant the release set out in this Section on that person's behalf as well as your own. Minors must remain in the care of a responsible adult throughout the event.

6. Photographic and Recording Release

1. The Harvest Festival will be photographed, filmed, live-streamed, and otherwise recorded.
2. By attending, you grant to Reap the Harvest Foundation, Inc. the irrevocable right and permission to record your image, likeness, and voice, and those of any minor in your care, and to use, edit, reproduce, publish, and distribute such recordings worldwide, in perpetuity, in any medium now known or hereafter devised, for promotional, fundraising, ministry, archival, broadcast, and educational purposes.
3. You acknowledge that no compensation is or will be due to you in respect of such use, that you waive any right to inspect or approve the finished materials or the use to which they are put, and that you release the Released Parties from any claim arising out of such use, including any claim for invasion of privacy, misappropriation of the right of publicity, or defamation.
4. Attendees who prefer not to be individually featured should notify a member of staff, and the Foundation will make reasonable efforts to accommodate the request. The Foundation cannot guarantee that any attendee will not appear in wide or crowd photography.

7. Conduct and Event Rules

1. The Harvest Festival is intended to be a safe and welcoming event for families. Every attendee agrees to:
   • comply with all posted rules and with the directions of staff, volunteers, and security personnel;
   • remain outside restricted areas, including backstage, service, and working areas of the farm not opened for the event;
   • conduct themselves respectfully toward other attendees, staff, volunteers, vendors, and animals; and
   • supervise minors in their care at all times.
2. The following are prohibited on the premises: weapons of any description; illegal drugs; alcohol not purchased on site; fireworks; unmanned aircraft and drones; open flame; pets (trained service animals excepted); professional recording equipment absent accreditation; and any other item the Foundation identifies as presenting a risk to safety.
3. The Foundation reserves the right to inspect bags and personal effects, to refuse admission, and to remove from the premises any person whose conduct is unsafe, unlawful, disruptive, or in breach of these Terms, in each case without refund.
4. Additional operational policies - including those governing parking, permitted items, re-entry, and accessibility - will be published at harvestlyh.com in advance of the event. Upon publication, such policies are incorporated into and form part of these Terms.

8. Accessibility

The Foundation is committed to making the Harvest Festival accessible to all who wish to attend. The event is held on a working farm with natural terrain, and certain areas may present difficulty for wheelchairs, mobility aids, and strollers, particularly in wet conditions. Attendees requiring accommodation are encouraged to contact the Foundation in advance at reaptheharvestfoundation@gmail.com so that available arrangements may be discussed.

9. Payment Processing and Personal Information

1. Tickets are sold through Zeffy, the Foundation's third-party ticketing platform. Payment and personal information submitted in the course of purchase are handled subject to Zeffy's own terms of service and privacy policy, in addition to these Terms.
2. The Foundation uses purchaser contact information to communicate event information and operational updates and, where the purchaser has elected to receive it, information concerning the ministry of the Foundation. Purchasers may withdraw from such communications at any time.
3. The Foundation does not sell purchaser personal information.

10. General Provisions

1. Governing law. These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles.
2. Venue and jurisdiction. Any dispute arising out of or relating to these Terms or to the event shall be brought exclusively in the state or federal courts serving Bedford County or the City of Lynchburg, Virginia, and each party consents to the personal jurisdiction of those courts.
3. Entire agreement. These Terms, together with any policies published at harvestlyh.com, constitute the entire agreement between the purchaser and the Foundation concerning the ticket and supersede all prior or contemporaneous representations, whether oral or in advertising.
4. Amendment. The Foundation may amend these Terms prior to the event. The version posted at harvestlyh.com as of the event date governs.
5. Severability. If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to render it enforceable, and the remaining provisions shall continue in full force and effect.
6. No waiver. The failure of the Foundation to enforce any provision on any occasion shall not constitute a waiver of its right to enforce that or any other provision subsequently.
